Welcome to JARTD. These Terms of Service ("Terms") govern your use of the JARTD mobile application (the "App") operated by Babu & Booshik LLC ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 12 years of age to use the App. JARTD is a social party game intended for entertainment. The App may contain mature humor and suggestive themes.

2. Responsible Use

JARTD is a social party game intended for entertainment purposes only. The App uses a generic "penalty" mechanic — players are free to define what a penalty means at their own table (a dare, a forfeit, a chore, or any other consequence agreed upon by the group). By using the App, you agree to:

Use the App in safe, appropriate settings.
Respect all players and ensure participation is voluntary.
Define and apply "penalties" in a manner that is lawful, safe, and consistent with your personal limits and local regulations.
Not use the App in any setting where the gameplay would be illegal, unsafe, or inappropriate.

Babu & Booshik LLC is not responsible for any consequences arising from activities chosen or performed by users during or after use of the App. You assume all risk associated with your use of the App and any activities performed while using it.

3. The App

JARTD provides randomized game prompts for social party gameplay. The App includes a free base experience and optional premium content available through subscription. We reserve the right to modify, update, or discontinue any features of the App at any time.

4. Subscriptions

Premium Subscription: JARTD offers premium subscription plans (monthly and annual) that unlock all current and future content packs for the duration of your subscription.
Pricing: Subscription prices are displayed in the App and processed through the Apple App Store or Google Play Store in your local currency.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing Your Subscription: You can manage or cancel your subscription at any time through your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions) or through the in-app subscription management center.
Free Trial: If a free trial is offered, any unused portion of the trial will be forfeited when you purchase a subscription.
Promotional Codes: We may distribute promotional codes that grant access to premium content via Apple App Store or Google Play. These codes are redeemed through the platform itself (not through this app), are non-transferable, limited in quantity, and may be revoked at our discretion.

5. Refund Policy

All subscription payments are processed by Apple or Google, and their refund policies apply:

Apple (iOS): You may request a refund within 48 hours of a subscription charge by visiting reportaproblem.apple.com, signing in with your Apple ID, selecting the charge, and choosing "Request a refund." Apple reviews and processes all refund requests.
Google (Android): You may request a refund within 48 hours of a subscription charge through the Google Play Store. Open Google Play, go to your purchase history, select the JARTD charge, and tap "Refund." Google reviews and processes all refund requests.

Cancelling your subscription stops future charges but does not issue a refund for the current billing period. Your premium access remains active until the end of the paid period.

We do not process refunds directly. For issues with your subscription, please contact Apple or Google support first. If you need further assistance, contact us at the email below.

6. Intellectual Property

All content in the App, including but not limited to game prompts, text, graphics, logos, icons, images, audio, and software, is the property of Babu & Booshik LLC and is protected by copyright and intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any content in the App.
You may not extract, scrape, or republish game prompts or other content from the App.
The JARTD name and logo are trademarks of Babu & Booshik LLC.

7. User Conduct

You agree not to:

Reverse-engineer, decompile, or disassemble the App.
Attempt to circumvent any security features, including the premium content paywall.
Use the App for any unlawful purpose.
Share, distribute, or sell promotional codes without our authorization.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, Babu & Booshik LLC, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use or inability to use the App.
Any actions taken during gameplay.
Any injury, illness, or damage resulting from activities performed while using the App.
Loss of data stored on your device.

10. Indemnification

You agree to indemnify and hold harmless Babu & Booshik LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of the state in which Babu & Booshik LLC is registered.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
